Family Responsibility Leave in South Africa
Maintaining a balance between both professional duties and personal commitments is challenging; therefore, BCEA has policies to assist workers with family responsibility leave. According to modern world values, in case a catastrophe occurs, the worker should have the leverage to take care of the family by taking leave from office. These leaves are known as family responsibility leave and are granted to those who are facing problems in their personal lives.
The purpose of the leave is to mentally relax the worker and let him focus on solving family issues. However, the leave is granted according to the policies of the organization and the state law of South Africa. Come with me to dig more about family responsibility leave and see a template to edit and submit a family responsibility leave application.
Family Responsibility Leave
Before we fall into the critical details, understand the hierarchy of family responsibility leaves. Basically, this category of leave is granted to the people who fall in the criteria for eligibility. Further, there are certain conditions when one can take leave; otherwise, the application may get rejected by the employer.
Additionally, the leave policies are designed by the state, but the company can change rules a bit, such as asking the worker to work from home or granting half-day leave instead of the entire day. Now, to understand the criteria of the responsibility leave, see below.
Eligibility Criteria By ECBA
- An employee worked for 4 months for the same employer.
- The applicant is employed for more than 4 days per week for the same employer.
- The applicant can take family responsibility leave once a year.
In this criteria, I have defined the eligibility according to the ECBA, but before you apply for leave, please check the company policies and rules. According to the ECBA, one can take 3 leaves per year for family responsibility. But if you find them less, you may apply for extended leave for a week or half a month.
Conditions When You Can Apply For Family Responsibility Leave
- The birth or illness of the employee’s child.
- The death of the spouse of the employee.
- If an employee is required to provide care to the elderly spouse or disabled parent.
- If an employee is required to attend a family emergency.
Because the rules and regulations are strict for family responsibility, one should provide evidence before requesting a leave. In the first condition of birth or illness of the child, employee can effortlessly take family responsibility leave.
But if you are requesting a leave to take care of the elderly spouse or disabled parent, then provide proof of the problem. The same rule applies to the death of a spouse or for a family emergency. The proof is required for the organization and government records.
Leave Installments
Sometimes we do not require 3 days leave but one day is enough for our responsibilities. In such cases, one can ask for the leave installments, and there can be three installments, each one based on single-day leave; for this, one has to mention in the application that the leave is based on the installments.
Here is a complicated query: can we take installment leaves in a week or a month with a gap, for example, a leave on January 1st and a second on February 5th? In such cases, the employer may grant you leave, but one has to mention in the family responsibility application that he wants a leave on specific dates and then mention the exact dates.
Paid Or Unpaid Leaves
Now, the interesting question is, will you receive paid leaves, indicating that the salary for these days will be included in the final pay, or will unpaid leaves mean that the employer will deduct the charges from your final amount? There is no black-and-white answer to this question because it depends upon the country and the company. In South Africa, a worker can get both paid and unpaid leaves, so there are no governmental restrictions.
But suppose the company policy is based on new models. In that case, you will receive paid leave because, according to the new models of running organizations, it is the right of an employee to take care of his family, and no authority can resist him. On the other hand, the old models of running organizations claim that it is the right of the employee to take leave for his family, but the company will not pay him for leave days because he is not on duty.
